Congratulations to Michele Katz, Advitam IP, and Bylgja Bjornsdottir, Tego IP Consulting, who recently secured a victory at the Trademark Trial and Appeal Board (TTAB). The Advitam IP team led by Michele Katz successfully opposed a company’s application of an infringing trademark at the TTAB. In this case, Advitam IP’s client is one of Iceland’s oldest and most popular design and manufacturing companies for outdoor sports apparel and protective wear. A competing company sought to register the mark NORTH 61 that was too confusingly similar to the client’s 66°NORTH mark. After the USPTO published the company’s mark for opposition, Michele and the team challenged the registration based on a likelihood of consumer confusion. The TTAB agreed and held that the company’s mark was too confusingly similar, ruling in favor of Advitam IP’s client! Now, the competing company cannot use its mark in the U.S. on its apparel. More importantly, Advitam IP’s client’s rights are well protected.
